Terms of Use for Website and Catering Services

Your use of the catering services, this website, and the online ordering service, i.e. the purchase by you of products and services from Synergy Catering Services Limited (“The Company”, “Synergy Catering”, “we”, “our” or “us”), is governed by these Terms of Use. Further, all information submitted to or received through this website will be treated in accordance with these Terms of Use. By using this website and submitting any order online and/or through any other methods to purchase our products and services, you signify your consent to these Terms of Use.

Eligibility and Registration

This website is directed solely at persons accessing the website from Hong Kong. If you are below the age of 18 years old or not capable of assuming legal responsibility, you should seek advice from your parents or guardians as to the meaning and consequences of these Terms of Use before using any of the services offered by Synergy Catering. By registering for this service, you represent and warrant that you have the capacity to understand, agree to and comply with these Terms of Use. You should provide true, accurate and complete registration information. As part of the registration process, you will be asked to select a password and you will be responsible for all activities occurring under your login name and for keeping your password secure. You shall be responsible for updating your registration information.

Synergy Catering has the absolute discretion to refuse the registration of a potential customer, or to terminate the registration of any customer, for any reason whatsoever.

Online Ordering

You will be liable for every order made under your login name and agree to indemnify Synergy Catering for all claims arising from the actions of a person submitting an order using your login name (including the unauthorised use of your email address by a third party).
Synergy Catering reserves the right to decline any order it may, in its opinion, consider unreliable having checked the user’s history or the payment details submitted for that particular order.

All catering orders must be completed at least 7 days before the delivery day. We shall revert acceptance of your order through email. You will receive an order confirmation email and payment notification for accepted orders. You must complete full payment of the order and upload the proof of payment (proof of payment uploading is applicable for PayMe or bank deposit payment) in 2 days upon receipt of the payment notification, otherwise your order will be automatically cancelled. After the order has been confirmed with payment made, cancellation of order will not be accepted.

WhatsApp Ordering

Please WhatsApp information about the delivery date, time, address, contact information, item selection and quantity to 9300 1828, and our dedicated personnel will follow up on your order accordingly.

All catering orders must be confirmed with payment made and proof of payment sent to us at least 7 days before the delivery day. Please make payment and provide us the proof of payment in 2 days upon receipt of our invoice, otherwise your order may be cancelled. After the order has been confirmed with payment made, cancellation of order will not be accepted.

Payment

Payment for products ordered through the online ordering service must be made in accordance with the online and offline payment methods as described in our order confirmation email, including Faster Payment System (FPS), PayMe, bank deposit and credit cards. Synergy Catering may change at any time the method by which payments for online orders may be made without prior notice.

Payment for products ordered through WhatsApp must be made in accordance with the payment methods as described in our invoice.

Other payment methods such as telegraphic transfer (TT) and express transfer (CHATS) are not accepted. We reserve the right to charge customers a handling fee and any bank charges incurred from other payment methods such as telegraphic transfer and express transfer.

After the order has been confirmed with payment made, neither cancellation nor refund of order will be accepted.

In case of order amendment, you must notify us by email or WhatsApp at least 3 working days (excluding the scheduled order delivery day) in advance. We shall review the amended order and reconfirm the order with you. If the amendment is made within 3 working days before the scheduled delivery day, you are required to pay an administration fee that equals to 30% of the total order amount. If your amended order cannot be confirmed for the scheduled delivery date, you can choose to reschedule the delivery date once provided that the amended delivery date falls within one month of the original scheduled delivery date, otherwise your order is deemed to be forfeited by you and all related order fees and administration fees already paid by you are non-refundable in any event. Working day means 9 am to 6 pm Mondays to Fridays excluding public holidays.

Online Payment

By using the online payment system you represent and warrant that you have obtained your credit card legally and have the capacity to enter into an online payment transaction.

Delivery

We shall use our best efforts to fulfill orders submitted through WhatsApp and the online ordering service, but Synergy Catering shall not be liable to any person if Synergy Catering shall decline to fulfill an order for whatever reason, or if Synergy Catering is unable to supply some or all of an order because of an unforeseen change to the products or because a product or an ingredient is unavailable.

Synergy Catering will only affect deliveries to the following areas in Hong Kong and the delivery areas may be updated from time to time without prior notice. Additional charges may be levied on deliveries to addresses located in specific areas. Synergy Catering makes no representation that deliveries to all locations within Hong Kong are available.

* Delivery Fee covers the service of delivering the ordered food to the designated location agreed between you and Synergy Catering. Delivery Fee does not cover other fee-charging services such as placing cutleries/crockeries, transferring the ordered food to other containers and reheating the ordered food. Please contact us in advance to provide separation quotations for door-to-door delivery or onsite services other than order delivery.

For door-to-door delivery, if there are stairs of 5 or more steps at the delivery location, you are required to pick up the order on the ground floor or pay a surcharge of $10 for each step or $50 for each storey.

For door-to-door delivery, if the delivery location is inaccessible by elevator (such as village house and tenement building), does not allow vehicle parking or parking is full at the time of delivery, you are required to pick up the order on the ground floor.

In the case of inclement weather (black rainstorm or typhoon signal no. 8 or above), unexpected traffic and situational issues that are beyond our control, we shall contact you to make other delivery arrangements and in any event Synergy Catering is not liable to any person. If your order delivery is cancelled owing to the above-mentioned reasons, you can contact us to reschedule the delivery once provided that the amended delivery date falls into one month of the original scheduled delivery date, otherwise your order is deemed to be forfeited by you and all related fees already paid by you are non-refundable in any event.

Delivery will be suspended when a black rainstorm or typhoon signal No.8 or higher is hoisted.

You must ensure that the order delivery is collected by a person at or above the age of 16 years old. Otherwise we shall make another delivery attempt and reserve the right to impose extra delivery fees and on such occasion, we are not liable for the quality of the ordered food.

You must notify Synergy Catering immediately of a change to your delivery address. We are not responsible for deliveries to the incorrect address if you fail to do so.

In support of environmental protection, disposable food tongs and cutlery will not be provided and you may order disposable food tongs and cutlery at the time of food ordering.

To ensure food safety and quality, please consume the ordered food as soon as possible upon arrival, or keep the food refrigerated and reheat it thoroughly before consumption.

Return of Products or Refunds

Not all pictures of products on this website will correspond exactly to the product and you shall not be entitled to refuse a product simply because it does not correspond exactly to its online picture.

We shall use our best efforts to ensure that orders are correctly fulfilled and shall deal with any discrepancies in the following manner, provided they are reported by calling our Customer Service Hotline on 93001828 within one hour of delivery of the products:

• If any product proves to have been delivered in a damaged condition, or if a product which was ordered and charged is not included in the delivery, or if an incorrect product is delivered in that product’s place Synergy Catering shall, at your option, either refund you the value of that product or deliver the product at no cost to you.
• If any product which was not included in your order is delivered to you by mistake, Synergy Catering reserves the right to collect the incorrect product at no charge to you.
• If you are charged more than the value of a product, Synergy Catering shall refund you the difference.

Refunds shall be made in the form of cash.

All replacement products shall be delivered in the shortest possible time after you have requested replacement in accordance with these Terms of Use. 

Product Information

Menu is valid for delivery and takeaway only. Synergy Catering shall make every effort to ensure that the prices, details and sizes of products contained in the website are correct but Synergy Catering reserves the right to vary the price and other product details without prior notice.

Images are for reference only.

Halal meal or veganism is not served in Synergy Catering. Synergy Catering is unable to guarantee that any item sold or supplied is free from ingredients derived from animals, nuts or other allergens. There is always a risk that such ingredients, or traces of them, may be transferred to items during processing, storage or preparation. Although Synergy Catering makes every effort to satisfy the special dietary requirements of its customers, it is unable to guarantee that such requirements can be met. Items supplied in Synergy Catering also provide crustacean, egg, fish, peanut, milk and nut products. If food allergy is a concern, please contact us in advance for other arrangement.

Use of the Website

You agree to abide by all applicable laws and regulations and are solely responsible for all acts or omissions by you, including the content of your transmissions through the online ordering service. By way of example, and not as a limitation, you agree not to:

• Create a false or misleading identity of a user of the online ordering service.
• Interfere with another user’s use and enjoyment of the online ordering service.
• Use the online ordering service in any unlawful manner or in any other manner that could damage, disable, overburden or impair the website or our services.
• Attempt to gain unauthorised access to the online ordering service or other accounts, computer systems or networks connected to that service.
• Collect email addresses, passwords or other contact information of other users of the online ordering service, by electronic or other means.
• Transmit, email or post any material that contains software viruses or such programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.
• Reformat or frame any portion of the web pages that are part of the website.

Privacy

Please refer to our Privacy Policy (which forms part of these Terms of Use) to see what information we may collect from you and how we use that information.
Order details and personal information used in the course of this purchase will be treated confidentially.

Intellectual Property Rights

This website and any information available on it, including text, graphics, icons, images and trademarks, are protected by copyright, trademark and other intellectual property rights owned or controlled by Synergy Catering or by third parties. You may not copy, reproduce, upload, download, transmit, store in retrieval system, modify, alter or display in public or distribute in any way the contents or any part of this site for any purpose without our prior written permission.

All concepts and systems relating to the online ordering service shall at all times remain the property of Synergy Catering.

This website may link to sites not maintained by or related to Synergy Catering. These links are provided as a service to our customers and are not maintained or controlled by Synergy Catering. Synergy Catering is not responsible for the content of any other site. These links are accessed at the user’s own risk and Synergy Catering makes no representations or warranties about the content, completeness or accuracy of any of these links or the sites linked to this website.

Liability

For the purposes of this section, “Synergy Catering” means Synergy Catering and each of our group or affiliated companies, licensors, partners, suppliers, employees, consultants and agents.
Synergy Catering disclaims any liability for the accuracy, content or completeness of the information on this website, or for the reliability, operability, security or availability of the website and/or the online ordering service function. Specifically, we disclaim any warranty of any kind, whether express or implied, that the website, the online ordering service function or the server that makes them available are free of viruses or other harmful components.
Whilst we shall use our best efforts to ensure that your order is correctly and satisfactorily fulfilled under the online ordering service, and we will deal with any discrepancies as set out in these Terms of Use, to the fullest extent permissible under applicable law Synergy Catering disclaims any warranty of any kind, whether express or implied, as to Synergy Catering’s products, including without limitation the availability, merchantability or fitness for any particular purpose of any product or ingredient.

In no event shall Synergy Catering be held liable for any delay or failure in performance resulting directly or indirectly from acts of nature or causes beyond its reasonable control including, without limitation, Internet failures, computer equipment failures, telecommunication equipment failures, other equipment failures, electrical power failures, strikes, labour disputes, shortages of labour or materials, fires, floods, storms, explosions, acts of God or delays or non-performance by third parties.

No agent or representative of Synergy Catering is authorised to make any warranties, representations or statements regarding the products or the online ordering service and Synergy Catering shall not in any way be bound by any such unauthorised warranties, representations or statements.

To the extent permitted by law, Synergy Catering shall not be liable for any direct, indirect, special, incidental, or consequential damages (including damages for loss of revenue, profits or data) arising in contract, tort or otherwise (including negligence) out of any use of, or inability to use, this website (including the online payment system).

Specifically relating to the online payment system, to the extent permitted by law, Synergy Catering will not be liable for any loss or damage (including indirect and consequential loss) suffered by you by reason of (i) any failure, delay, interruption, suspension or any other restriction affecting your Online Payment; (ii) any errors, malfunctions or breakdown of your bank’s payment mechanism; or (iii) any other matter arising out of, or in connection with, the online payment system.

In any event Synergy Catering shall not be liable to you for any amount exceeding either the price of the products ordered under the online ordering service which are the subject matter of any liability or, in the absence of such an order, HK$1,000.

Miscellaneous

We reserve the right to change the information, services and resources available on this website, and these Terms of Use, at any time. These Terms of Use will be governed by and construed in accordance with the laws of Hong Kong, and the parties agree to submit to the exclusive jurisdiction of the courts of Hong Kong. If for any reason a court finds any provision or portion of the Terms of Use to be unenforceable, the remainder of the Terms of Use will continue in full force and effect. Any waiver of any provision of these Terms of Use by a party will be effective only if in writing and signed by a party. The applicability of these Terms of Use shall survive any termination of your registration for the online ordering service.

In case of discrepancies between the English and Chinese versions of these Terms of Use, the English version shall apply.
